At Kublanovsky Law we are sensitive to the tremendous financial burden companies and individuals face even before a lawsuit is commenced or a single pleading filed. Disagreements among business owners are especially difficult – and expensive – to resolve through litigation. Often, these disputes grow more complicated (even when the business disagreements are relatively straightforward) and costly for all sides because each member or co-owner must retain separate legal counsel to represent their interests in court, which only multiplies the costs for each member and the business as a whole. Even if these business disputes are ultimately resolved in mediation before a court action has been commenced, each side has generally spent thousands (and more often than not, tens of thousands) of dollars in attorney’s fees and mediation expenses. If the parties are forced to litigate in court before the first mediation session even takes place, the costs to each side are only more pronounced.
It is for these reasons that we have launched the Kublanovsky Law Business Owners Dispute Resolution Program. Our dispute resolution program provides business owners with a quick and cost-effective mediation option for working through their disagreements together before they get out of hand and require costly litigation. Business owners who jointly agree to engage Kublanovsky Law to mediate their dispute have the option of participating in either a 4-hour or 8-hour mediation process, depending on the complexity of the matters the parties need mediated. As in a traditional mediation, the parties split the cost of the mediation. However, unlike a traditional mediation, the cost of the mediation is based on a reasonable fixed fee. Through a combination of one-on-one teleconferences with each party, and a joint in-person or video-conference mediation session, Kublanovsky Law will work with the parties to focus on the key areas of their disagreement with the goal of assisting the parties in reaching a resolution by the end of the mediation process. Importantly, Kublanovsky Law does not serve as counsel to any individual party during the mediation, but is instead engaged to provide mediation services to the parties’ and their business. During this process, Kublanovsky Law serves as an honest broker – a third-party, objective neutral assisting the parties in reaching a solution to the problems affecting each of them and their business. While the parties are, of course, free to retain separate counsel to assist them during this process, the goal of the Business Owners Dispute Resolution program is to efficiently and cost-effectively conduct a mediation with minimal legal fees and expenses for all sides.
